Online pharmacy in Spain — what is legal and what is not

The single rule that decides everything

Under Spanish law, only non-prescription medicines may be sold at a distance to the public, and only through the website of an authorised physical pharmacy. This framework comes from Royal Decree 870/2013, which implements the European rules on distance selling of medicines.

Everything else follows from that one sentence:

• A website may legally sell you paracetamol or an OTC cough preparation if it belongs to a registered Spanish pharmacy that has notified the authorities.
• The same website may not sell you antibiotics, sleeping tablets, strong painkillers or any other prescription-only medicine, even if you have a prescription.
• Prescription medicines in Spain are dispensed in person, at a pharmacy, against a valid prescription.
• There is no such thing as a legitimate Spanish website that ships prescription medicines to your door after an online questionnaire.

If a site offers to do that, it is telling you clearly that it operates outside the rules — and you have no way of knowing what is in the package.

How to check whether a pharmacy website is real

Verification takes about a minute and is worth doing every single time:

• Look for the EU common logo. Legitimate distance-selling pharmacies in the EU display a standard rectangular logo containing the national flag. It is not decorative: clicking it must take you to the official national register.
• Check the Spanish register. AEMPS, the Spanish medicines agency, publishes the official listing of authorised pharmacy websites (the DistaFarma information service). If the site is not there, it is not authorised to sell medicines at a distance in Spain.
• Find the physical pharmacy. A real web pharmacy is the online shopfront of a licensed premises, with a named responsible pharmacist, an address and a registration number.
• Check what it refuses to sell. A compliant Spanish site will not offer prescription-only medicines. Its restraint is evidence of legitimacy.
• Be suspicious of prices and promises. Deep discounts on well-known prescription brands, "no prescription needed", and bulk offers are the classic markers of falsified supply chains.

The EU register exists precisely because falsified medicines reach patients overwhelmingly through unverified websites rather than through pharmacies.

Comparing the routes — and where they differ

The fourth row is the one patients most often misread. A telemedicine platform does not dispense anything. It is where the clinical decision happens; the pharmacy is where the medicine is supplied.

Why prescription medicines need a consultation first

The prescription requirement is not bureaucratic friction. Medicines that need a prescription need one because the decision to use them depends on facts that only an assessment can establish: what is actually wrong, what else you take, what you react to, your kidney and liver function, whether you are pregnant, your age and weight, and whether the benefit outweighs the risk in your specific case.

Antibiotics illustrate the point. Taken for a viral illness, they cannot help you, may harm you, and contribute to antimicrobial resistance — a problem Spain takes seriously through national programmes. A website that sells them to anyone who asks is not offering convenience; it is removing the only step that made the medicine safe.

This is also why a consultation is never a guarantee of a prescription. If the assessment does not support treatment, the correct professional answer is no, with an explanation.

How prescribing actually works in Spain

There are two parallel prescription systems, and knowing which one applies to you avoids most confusion.

Public (SNS) electronic prescription. Patients registered in the public system receive electronic prescriptions linked to their individual health card. You collect medication at any pharmacy in your region, usually with the card alone, and repeat treatments are dispensed across a defined period. Each autonomous community runs its own system, with interoperability between them.

Private prescription. Doctors working privately — including in telemedicine — issue private prescriptions in a valid format identifying the prescriber, the patient and the medicine. Pharmacies dispense against them, and you pay the private price.

Controlled substances, psychotropics and certain other groups carry stricter requirements and are frequently unsuitable for a remote first consultation altogether. Travellers: bringing and buying medicines in Spain

Visitors run into predictable problems, most of them avoidable:

• Bring enough of your own medication for the whole trip, in original packaging, with a copy of the prescription or a doctor's letter. Replacing a foreign prescription abroad is slower than people expect.
• Brand names differ between countries. Take a note of the active substance and dose, not just the trade name, so a Spanish pharmacist or doctor can identify it.
• A foreign prescription may not be dispensable in Spain, depending on its origin and format. Cross-border prescriptions have rules, and pharmacies apply them.
• Do not order replacements from unverified websites while travelling. This is the highest-risk moment for exactly the wrong reason: urgency.

Warning signs of an unsafe website

Treat any of the following as a reason to close the tab:

• "No prescription required" for medicines that legally require one.
• No physical address, no pharmacist named, no registration details.
• No EU common logo, or a logo that links nowhere or to the site itself.
• Payment only by transfer or cryptocurrency.
• Medical claims about curing conditions, or pressure tactics and countdown timers.
• Prices far below the normal range for a well-known medicine.

Falsified medicines can contain the wrong dose, the wrong substance, no active ingredient at all, or genuine contaminants. The risk is not theoretical, and it is not detectable by looking at the packaging.
